Terms & Conditions
The following terms and conditions contain essential information regarding your legal rights, remedies, and obligations. Please do not proceed with any booking through Mona Meli Luxury Travel Co. unless you fully understand and agree to these terms and conditions.
By making a booking, you acknowledge that you have read, understood, and agreed to abide by these terms and conditions, which will govern all bookings made with Mona Meli. The contract established under these terms and conditions is exclusively between you and Mona Meli, not with any other travel service provider.
We trust that the individual making the booking has the authority to act on behalf of all travellers included in the booking (even if payments are made separately) and that this person will ensure all travellers are bound by these terms and conditions.
1. Passports & Visas:
All travellers must possess a valid passport for international travel. Many countries require that the passport has at least six months of validity from the return date, and some may also require a machine-readable passport.
While we can offer general information regarding visa and passport requirements, it is your responsibility to secure the necessary visa for your travels. We do not apply for visas or other travel documents on your behalf; organising these documents is entirely your responsibility. Any fines, penalties, payments, or expenses arising from failure to meet these requirements, will be solely your responsibility.
We do not guarantee the accuracy or appropriateness of information provided by any external service providers and accept no liability for any loss or damage you may experience as a result of relying on such information.
2. Travel Documents:
Travel documents include, but are not limited to, flight itineraries with booking references and airline information, hotel vouchers, tour vouchers, or any other documentation (whether in electronic form or otherwise) that confirms an arrangement with a travel service provider. These documents may be subject to specific conditions and restrictions, such as being non-refundable, non-changeable, and/or subject to cancellation or other change fees.
Travel documents are non-transferable and cannot be used by another person. All airline tickets must be issued in the name of the passport or photo ID holder. It is essential that your name matches exactly across your passport, visa, and other travel documents. An incorrect name on a booking could result in the inability to use that booking, its cancellation, and the imposition of additional change or cancellation fees. Once the final itinerary is signed and agreed upon, any fines, penalties, payments, or expenses incurred due to these documents not meeting the required standards of the relevant authorities will be your sole responsibility. We will not be responsible for any expenses, fees, penalties, costs, liabilities, damages, or losses related to baggage allowances or excess baggage.
3. Travel Insurance:
We highly recommend that you obtain suitable travel insurance to protect your travel arrangements. If you choose not to arrange travel insurance through us with our provider, you will be required to sign a waiver confirming that you have declined this coverage.
4. Health:
You are responsible for being informed about any health requirements and recommended precautions related to your travel plans, as well as ensuring you have all necessary vaccination documentation. In some cases, failing to provide required vaccination proof (e.g.,Yellow Fever vaccination) may result in denied entry into a country. Medical requests are beyond our control, so it is your responsibility to address them directly with the travel service provider, either at your destination or before traveling, whenever possible.
5. Prices:
All prices are subject to availability and may be altered or withdrawn without prior notice. The price is guaranteed only once your booking has been paid for in full. Please be aware that quoted prices can change. Such changes may result from factors beyond our control that increase the cost of the product or service, including, but not limited to, unfavourable currency fluctuations, fuel surcharges, taxes, and airfare increases.
6. Deposits and Final Payment:
You may need to pay a deposit or multiple deposits when making a booking. We will inform you of the deposit amount required. Except as provided by Australian Consumer Law, all deposits are non-refundable if you change your mind or cancel, or if the travel service provider’s terms state that deposits are non-refundable.
A deposit will secure your booking, but quoted prices may change before you make the final payment. The amount of the final payment may vary based on the supplier’s terms and conditions. All airfares must be paid in full at the time of booking. Please note that our booking fee is non-refundable. If you cancel the entire booking and wish to rebook at a later time, a new booking fee will be required.
7. Mona Meli’s Change and Cancellation Fees:
If you cancel any part of your travel, Mona Meli will charge a cancellation fee of 5% of the value of the cancelled service or product.
8. Travel Service Provider Change and Cancellation Fees:
Changes or cancellations of bookings, for any reason—including those beyond your or our control, may result in fees imposed by the travel service provider, which can be up to 100% of the booking cost, regardless of whether travel has begun. Travel service provider fees may also apply if a booking is altered or if tickets or documents are re-issued. If we incur any liability for a change or cancellation fee charged by a travel service provider, you agree to indemnify us for that amount. For non-refundable bookings, if a travel service provider cancels your booking, you may not be entitled to a refund, travel credit, or other compensation from either the provider or Mona Meli, depending on the provider’s change or cancellation policy.
In cases of unavoidable or extraordinary circumstances leading to booking cancellations, the travel service provider might offer a travel credit subject to their hardship policy. If no refund is provided by the service provider, Mona Meli will not issue a refund, and you should seek compensation through your insurance provider.
9. Change or Cancellation by You:
Any changes you make will be subject to applicable travel service provider fees, Mona Meli cancellation fees, and any change fees specified in your quote, tax invoice, and/or itinerary. You may also be responsible for any price increases resulting from your change request.
If you cancel any part of your booking, you will forfeit your deposit and be required to pay any applicable travel service provider fees and cancellation fees as outlined in your quote, tax invoice, and/or itinerary. We will refund any remaining funds, if applicable.
Alternatively, the service provider may offer you a travel credit for the full amount paid, without deducting any travel service provider fees or our cancellation fees. For instant purchase non-refundable bookings, if you cancel any part of your booking, you will not be entitled to a refund, travel credit, or any other compensation from the travel service provider or Mona Meli.
10. Emergency Assistance:
Currently, we do not offer 24-hour support for urgent inquiries regarding your travel booking. Mona Meli is not responsible for providing assistance outside of business hours. In case of an emergency, we recommend contacting local emergency services, the suppliers related to your booking, or your travel insurance provider. Any actions you take outside of our business hours that result in financial costs or inconvenience are not eligible for compensation from Mona Meli. Our office hours are Monday to Friday, 9am to 5pm Western Australian Standard Time, or otherwise advised at the time of your booking.
11. Payments by Credit Card and Debit Card:
Any credit card surcharges outlined in your quote, tax invoice, and/or itinerary, will apply when making payments by credit card.
You authorise Mona Meli to charge all fees related to the services provided to the credit or debit card you designate. If payment is not received from the card issuer or its agents for any reason, you agree to pay the outstanding amounts immediately upon request. If you opt to save your credit card details with us, they will be stored securely and may be used for future transactions with Mona Meli v, including those agreed upon via phone or email. You can remove your saved credit card details at any time.
12. Agency:
We act as an agent, representing and selling various travel-related products on behalf of numerous service providers, including airlines, accommodation providers, tour operators, and restaurants.
Our role is to provide booking and advisory services, including making travel arrangements and facilitating contracts between you and the travel service providers. While we carefully select reputable travel service providers, we are not a travel service provider ourselves and have no control over, or liability for the services offered by third parties.
Your legal rights related to travel services are directed against the specific service provider, not us, unless the issue is due to our own fault. Specifically, if a travel service provider fails to deliver the services for which you have contracted (excluding fault on our part), your recourse is with that provider, not with Mona Meli.
13. Liability:
To the extent permitted by law, we are not liable for any injury, damage, loss (including consequential loss), delay, additional expense, or inconvenience arising directly or indirectly from the actions, omissions, or defaults of third-party providers, over whom we have no direct control, force majeure, supplier insolvency, or any other events beyond our control, or which cannot be prevented through reasonable diligence on our part.
Our liability is also limited by relevant international conventions, such as the Montreal Convention for air travel, the Athens Convention for sea travel, the Berne Convention for rail travel, and the Paris Convention for accommodation, which set limits on compensation for death, injury, delay, and loss or damage to luggage. Where our liability cannot be excluded but can be lawfully limited, it is confined to the remedies required under applicable law, including the Australian Consumer Law.
This liability clause does not affect your rights under the Australian Consumer Law and nothing in these booking terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).
14. Supplier Insolvency:
To clarify and without limiting Section 12, if a third-party provider cannot fulfill your booking due to insolvency or being placed under external administration, we are not obligated to reimburse you for the cost of your booking or for any loss or damage you may incur as a result of such insolvency or external administration. This is subject to your rights to refunds and remedies under the Australian Consumer Law.
15. Privacy Laws:
We are dedicated to safeguarding your personal information and will handle it in compliance with applicable privacy, data protection, data breach notification, and anti-spam laws (privacy laws).
By providing your personal information to us, you consent to our collection, use, and disclosure of your information as outlined in these booking terms and conditions and in accordance with privacy laws. Specifically, you agree that, in certain situations (such as booking international travel for you), we may disclose your personal information to overseas recipients. This includes overseas travel service providers (e.g., airlines, accommodation, or tour operators) with whom you book.
These service providers will generally receive your personal information in the country where they will deliver services, or where their business is located. We may also share your personal information with service providers who assist us both within and outside Australia.
16. Monies Not Held On Trust:
You acknowledge and agree that any funds paid to us will not be held in trust for you. We may deposit these funds into any account we choose, including our own or other customer accounts. All funds paid by you are considered a debt owed to the travel service provider, based on the payment terms agreed upon with that provider. Typically, payment will be made direct to the travel provider by you agreeing to a card authorisation form to the travel service provider before the related services are provided, though in some cases, payment may be made after the services are rendered. If at any time we hold the funds, we can only issue a refund once authorised by the travel service provider, in accordance with their change or cancellation policy.
17. Modifications to These Booking Terms and Conditions:
We reserve the right to alter any of these booking terms and conditions at any time without prior notice. If changes are made, we will post the updated terms on our website, applications, or services, and these changes will take effect upon posting. The terms applicable to your booking will be those in effect at the time of your booking.
You acknowledge that you are 18 years of age or older and that you understand and agree with the above Terms and Conditions.
